The President intentionally signed the Expanded Maternity Leave Act on February 20, 2019, one day before it would have lapsed into law.  That is good news!

What do we need to know about the new law?  Read this:

Previously on Maternity Leaves:

  • Female employees were entitled to 60 days of paid leave for normal delivery.
  • Cesarean deliveries are allowed up to 78 days of paid leave.
  • This is granted to all female employees, regardless of marital status, and applies even if the pregnancy did not reach its full term (miscarriage).
  • The privilege may be enjoyed by a female employee until her fourth pregnancy, including miscarriages.

The Expanded Maternity Leave Act:

  • The law grants 105 days of paid maternity leave to all employed mothers.
  • With an option to extend the period for another 30 days without pay.
  • Maternity leave will be granted to women at every instance of pregnancy.

We shall update this post as soon as the Implementing Rules and Regulations (IRR) have been released by the DOLE.

Pag-IBIG offers the provision of home financing programs for both new and repossessed (or acquired) housing properties that were developed by Pag-IBIG.  Active members have the option to purchase an acquired Pag-IBIG property at negotiated rates.

Acquired assets are foreclosed properties (house and lot) that are auctioned off by Pag-IBIG to the public at cheaper rates.  These are not “brand new” houses; these are properties that are repossessed due to non-payment of the original owners.  Once auctioned by Pag-IBIG, it becomes a possible alternative for other active members that are unable to take on the costs of a brand new housing unit.

If you are thinking of applying for a Pag-IBIG housing loan, it may be good to weigh your options and see if an acquired asset is something you can consider.

Here are the steps and requirements needed when applying for a Pag-IBIG loan for acquired properties under negotiated sale:

  1. Reserve the property and pay the Php 1,000 reservation fee (non-refundable/non-transferrable). Bring one valid ID and choose among the following modes of payment:
  • Cash – 30% discount; payment term of 1 month.
  • Installment – 20% discount; up tp 12 months only, with 12% interest rate per annum.
  • Housing Loan – 10% discount, for qualified members of Pag-IBIG Fund; up to 30 years, provided that borrower’s age shall not exceed 70 years old at date of loan maturity.
  1. For purchase through housing loan, submit the complete documentary requirements within 30 calendar days from payment of reservation fee and pay the processing fee of Php 2,000 and Documentary Stamp Tax of Php 100.00.
  2. Receive the Notice of Approval of Loan and pay the one (1) year advance insurance premiums within 30 days.
  3. Execute and submit the notarized Deed of Conditional Sale and other mortgage documents evidencing the loan in favor of the Fund.

Below are the BASIC REQUIREMENTS for:

SELF-EMPLOYED applicants:

  • Accomplished Buyer’s Information Sheet (2 copies) with recent 1×1 ID photo (2 copies).
  • One (1) valid ID (photocopy, back to back) of Principal Buyer and Spouse, Co-Buyer and Spouse, if applicable.
  • Proof of Income for (any of the following):
    1. Owned Business
      • Income Tax Return (ITR)
      • Audited Financial Statements
      • Official Receipt of Tax Payment from bank supported with DTI Registration and Mayor’s Permit/Business Permit.
    2. Commission Base
      • Commission Vouchers reflecting the issuer’s name and contract details (for the last 12 months).
    3. Drivers
      • Certified True Copy of Transport Franchise issued by an appropriated government agency (LGU for tricycles, LTFRB for other PUVs).
    4. Foreign Remittances and Pensions
      • Bank Statements or passbook for the last 12 months (in case income is sourced from foreign remittances, pensions, etc.
    5. Rental Payments
      • Copy of Lease Contract and Tax Declaration (if income is derived from rental payments).
    6. Sari-sari Store/Mini Groceries, Sub-contractor, On-call Maintenance, Technician
      • Brgy. Certificate/Clearance
      • Properly Accomplished Certificate of Engagement, duly notarized.

Additional Requirements:

  • Copy of Frequently Asked Questions (FAQs) with signature.
  • Photocopy of Php 1,000 reservation fee receipts.
  • Photocopy of 1 valid ID of the signatory in the Certificate of Engagement
  • Insurance Coverage (if applicable only)
    • Health Statement form (Medical Questionnaire)
      • For borrowers over 60 years old
      • For borrowers up to 60 years old, if loans are over P2.0M to P6.0M
    • Health Statement Form (Medical Questionnaire) and a copy of the result of a medical examination conducted prior to assignment overseas as required by the employment agency.
    • For OFW borrowers over 60 years old.

Locally Employed

Basic Requirements:

  • Accomplished Buyer’s Information Sheet (2 copies) with recent 1×1 ID photo (2 copies)
  • One (1) valid ID (photocopy, back to back) of Principal Buyer and Spouse, Co-buyer and Spouse, if applicable.
  • Proof of Income (any of the following):
    • Notarized Certificate of Employment and Compensation (CEC) indicating the gross monthly income and monthly allowances or monthly benefits received by the employee.
    • Certified One (1) month payslip, within the last three (3) months prior to date of loan application.
    • Latest Income Tax Return (ITR) for the year immediately preceding the date of loan application, with attached BIR Form No. 2316, stamped received by the BIR.

Note: Government employees must present one-month payslip issued within the last three months prior to the date of loan application and submitted together with CEC or ITR.

Additional Requirements:

  • Copy of Frequently Asked Questions (FAQs) with signature.
  • Photocopy of Php 1,000 reservation fee receipt.

Insurance Coverage (if applicable only)

  • Health Statement Form (Medical Questionnaire)
    • For borrowers over 60 years old
    • For borrowers up to 60 years old, if loans are over P2.0M to P6.0M
  • Health Statement Form (Medical Questionnaire) and a copy of the result of the medical examination conducted prior to assignment overseas as required by the employment agency.
    • For OFW borrowers over 60 years old.

So the DFA needs our help in rebuilding their database and we can do so by presenting a copy of our PSA birth certificate when renewing our passports.  Do you have a copy of your birth certificate yet?

I used to keep several copies of my birth certificate in my desk; these were printed on the old yellowish sheet with NSO’s logo on the upper left hand (or was it right?) corner of the document.  When my passport was due for renewal last June 2016, I was advised by my friend to secure a new copy of my birth certificate before going to the DFA for my application.

“Bakit, may expiration ba ang birth certificate? Di ba wala naman?”

Of course, my birth certificate does not have an expiration date!  What my friend was trying to tell me (pala!) was that the PSA (formerly NSO), regularly updates (or maybe, reprints) the copies of our documents on security papers to discourage the circulation of unauthorized and fake copies made elsewhere.  Embassies and other government agencies are duly advised whenever the PSA is set to release certificates printed on new security papers so that these offices would know when the documents being presented to them are updated copies or old files (like my copies of my birth certificate).

So if you think you still have several copies of your birth certificate left in your stash, check them now to make sure these are updated ones.  Foremost, it must bear the new seal of the PSA, and not the former NSO.  If your document is worn out, has some minute tears, or the entries are hardly readable, please get yourself new copies.

I got my latest copies from PSAHelpline.ph.  It’s an online, one-stop birth certificate ordering site for all types of PSA documents you will ever need: birth, marriage, CENOMAR, and death certificates.  They deliver nationwide too so you won’t have to go to a PSA office anymore.

Birth, marriage, and death certificates cost Php 365.00 per copy while the CENOMAR costs Php 465.00 per copy.  Visit their user-friendly website now so you can place your orders ahead of the others!

Word of the wise: As soon as you have confirmed an appointment with the DFA for your passport application or renewal, get new copies of your PSA birth certificate and marriage certificate (for married female applicants who wish to change their last name in their passport).  Don’t wait until the last minute to do this because it’s a primary documentary requirement, especially if your old passport is not an e-passport.

Securing an appointment with the DFA to apply for a passport or have your old one renewed has proven to be quite a challenge for most.  Good thing the DFA has made courtesy lanes available for certain types of applicants.

Here is the list of requirements in order to be eligible for the DFA’s courtesy lanes:

  1. Senior Citizens (60 years old and over).
  • Senior citizens are allowed one companion.
  • The companion of the senior citizen must be an immediate family member (i.e. spouse, siblings, adult children, adult grandchildren, and children-in-law of the senior citizen and must show proof of relationship.
  • If the companion is not an immediate family member, the companion has to show proof of travel arrangements (e.g. confirmed plane or hotel booking) with the senior citizen to be able to avail of the courtesy lane facility.
  1. People with disabilities (PWDs) with proof of disability.
  • PWD is allowed one (1) companion.
  • The companion of the PWD must be an immediate family member, i.e. spouse, siblings, adult children, adult grandchildren, parents-in-law, and children-in-law of the PWD and must show proof of relationship.
  • If the companion is not an immediate family member, the companion has to show proof of travel arrangements (e.g. confirmed plane or hotel booking) with the PWD to be able to avail of the courtesy lane facility.
  1. Solo parent with valid solo parent card, and his/her minor children.
  2. Minors seven years old and below and his/her parents and minor siblings.
  3. Pregnant women
  • If pregnancy is not visible, the applicant must present medical certificate/records.
  1. Overseas Filipino Workers (Land and Sea-based) with valid proof of status, such as:
  • Valid iDOLE card
  • Valid employment contract
  • Valid work visa
  • Seaman’s book stamped at international border less than 365 days from the date of application.

Senior citizens, PWDs, solo parents, and their minor children, pregnant women, and OFWs have the option to choose from regular or expedited processing of their passport application.

The companion of the senior citizens and PWDs, minors seven years old and below, their parents and minor siblings, are to be assessed expedited processing fee because they are not entitled to use the courtesy lane; they are accommodated for their convenience.

All applications made on Saturdays – whether those entitled to use the Courtesy Lane Facility or those accommodated for their convenience – shall be assessed expedited processing fees based on the relevant provision of the Passport Act.

Getting a ticket for a traffic or vehicle regulation violation means you will not only have to stop and spend a good 15 to 20 minutes negotiating with a traffic enforcer but also that you will have to pay the prescribed fee for the violation you committed.  It is both a pain in your schedule and your pocket that is why most drivers do everything in their capacity to avoid (or sometimes, evade!) these violations.

Among these violations are driving without a valid license which will cost you Php 3,000, reckless driving at Php 2,000 for the first offense, and parking violations that start at Php 1,000 for the first offense.

Today we will feature the violations that have stiffer penalties (translation: they cost a fortune!); these fines are so dear that the average Pinoy driver’s only means to pay for it is by completely avoiding the violation altogether.

  1. Driving a right-hand drive vehicle – Php 50,000

So your car was imported from Europe… big deal.

You should not be driving a right-handed vehicle in the Philippines unless you have Php 50,000 to spare for LTO.  This violation was only recently added to the list when car smuggling became a rampant case n the 2010s.  Also, driving a right-hand vehicle in the Philippines could pose more risk to drivers and pedestrians.

Should you insist in driving your RHD car in main thoroughfares (and you get caught!), your precious car will be impounded until you are able to have it corrected (translation: made into a left-hand drive vehicle).

  1. Driving a vehicle that has defective devices or is installed with improper or unauthorized accessories – Php 5,000

That’s not a collective amount, mind you.  You will be fined Php 5,000 for EVERY violation found in your car.  Example: your signal lights are not working, that’s Php 5,000; you have a carrier on the roof of your car that does not meet the standards of the LTO, that’s another Php 5,000.

  1. Passengers not wearing seatbelts – Php 1,000 (private cars), Php 3,000 (PUVs).

This law (yes, it’s a law!) that is meant to protect you from harm (similar to the law on the use of helmets for motorcycle drivers and passengers).  And so if you get penalized for not obeying this particular law, you are actually being fined for not loving your life enough to save it by wearing a seatbelt.

If a traffic enforcer sees you or your passenger not wearing your seatbelts, the driver will be fined the corresponding fees for private cars and PUVs, plus the driver’s license will be suspended for a week.  Ugh if you are a PUV driver.

  1. Smoke Belching – Php 2,000 (first offense)

If you and your car cause other drivers and pedestrians to cover their noses when you zoom past, you are smoke belching.  It also means that your car is in bad shape and should not be allowed on the road.

Should you insist, you will be fined Php 2,000 and who knows how much more after your first offense.

  1.  Fraudulent registration of your car – Php 3,000

The LTO would know when you have overlooked or failed to renew your car’s registration.  On the other hand, your car’s registration is one of the first things a traffic enforcer or the police look for when you are flagged for a traffic violation.  If your papers are not updated, then better prepare for a hefty fine and the risk of you not being able to drive your car for a year.

It is never wise to forego your responsibility in renewing your car’s registration; you will always end up spending more.

A basic requirement for passport renewal is the submission of the expired (or expiring passport) so the DFA can cancel its validity.  But what if the old passport has gone missing?

Here’s how you can renew a lost and expired passport:

GENERAL REQUIREMENTS:

  • Personal appearance.
  • Confirmed appointment.
  • No need to submit a passport size photo.
  • Submit same documents required for first-time passport applicants.

ADDITIONAL REQUIREMENTS in case the passport was lost and cannot be found:

  • Submit a Notarized Affidavit of Loss (with detailed explanation on when, where, and how the passport got lost).
  • If the lost passport is still valid, submit a Police Report.
  • If available, bring a photocopy of the first page of the lost passport.

Take note that there will be a 15-day clearing period prior to the processing of an application for replacement of a lost valid passport.

IN CASE PASSPORT WAS ALREADY DECLARED LOST BY THE APPLICANT BUT EVENTUALLY WAS FOUND AND RETURNED TO THE APPLICANT:

  • Submit a Notarized Affidavit of Retrieval (with detailed explanation on when, where, and how passport was found).
  • Original and photocopy of the first and last page of the passport.

IN CASE OF MUTILATED OR DAMAGED PASSPORTS:

  • Submit a Notarized Affidavit of Mutilation (with a detailed explanation of when, where, and how the passport got mutilated or damaged).
  • Original and photocopy of the first and last page of mutilated or damaged passport.

IN CASE APPLICANT WAS ISSUED A TRAVEL DOCUMENT:

  • Original Travel Document
  • Submit a Notarized Affidavit of Explanation Regarding Issuance of Travel Document (with a detailed explanation of when, where, and why the applicant was issued a travel document).
  • Original and photocopy of the first and last page of canceled passport (if the passport is still in the possession of the applicant).

It is not advisable to pose as a first-time passport applicant if you lost your passport.  The DFA will see your previous passport details anyway and you will be required to submit the same documents (affidavit of loss, etc.) as listed above.  Your appointment will be wasted and you may run the risk of being placed under questionable applications.

To help everyone appreciate how the adjustment impacts an employee’s contribution (and effectively, the salary deduction he should anticipate as a result of the rate increase), we are sharing the following table lifted from PhilHealth’s official Facebook page.

Our family will be traveling to Japan later this year and we are currently in the process of completing all our documentary requirements for our visa application.  I was tasked to take care of everyone’s copies of PSA birth and marriage certificates, and make sure these are ready for submission by the end of the month.

Back in the ‘90s, this would have been a herculean task – traveling all the way to an NSO branch (PSA used to be called NSO), lining up for my turn, and waiting until they are able to release my requested documents.  With the 15 names and 4 marriages in my list that needed PSA certificates, it would have taken me the whole day to get the errand done.  I would have had to take a leave from work and spend extra on gas, parking, and food.

Good thing I can do all these online now, through PSAHelpline.ph.  The moment I got my assignment from my Tita during our Sunday family lunch, I immediately borrowed by cousin’s laptop and began submitting my orders online.  The process is really easy and simple:

  1. Log on to www.psahelpline.ph and click on the type of certificate you need (in my case, 15 birth certificates and 4 marriage certificates).  Take note that you will be placing one order for each person’s certificate (I had to be patient, but only for 30 minutes, not an entire day!).
  2. Choose the reason for ordering the certificate.  I chose the first one: Passport/Travel; I also had to select the country we were traveling to.
  3. You will be taken to a page where you’ll have to type the certificate owner’s information.  If you are applying for a different person (other than yourself), it’s best to have their complete information handy so you don’t waste your time going back and forth, asking for their personal details.  This is why I endeavored to finish the task while the entire family was literally, “under the same roof”.
  4. After submitting all your information, you will be asked if you had any procedure done on your certificate such as: Correction of Entries, Legitimation, Adoption, Court Hearings, and Supplemental.  If you’ve never had any, just click on “None”.
  5. The next page will ask who is requesting for the document.  Anybody can request for a person’s birth certificate PROVIDED he is of legal age and has a valid ID that matches the name on the application form.  The ID will be presented to the courier upon delivery.  On the same page, you will also be asked for authorized representatives who can receive the documents on your behalf in case you are not around when the courier arrives.  Again, these representatives must have valid IDs that they can present upon documents’ delivery.  As the requesting party, you must also provide the representatives with a Letter of Authorization and one of your valid IDs.
  6. On the Checkout page, you have a chance to double check all the information you provided.  Before submitting your request, you will be asked to provide your contact information, the complete delivery address, and the number of copies you need delivered.  One copy costs P350, this already includes processing and delivery.
  7. Upon hitting the “Submit” button, you will be taken to the confirmation page.  You will then receive an email from PSAHelpline with your order number and the different modes of payments.
  8. Pay and wait for your orders to be delivered.

And now, the easier part: paying for my orders!  I was delighted to see that PSAHelpline now has various payment center partners that we could choose from.  Normally, I would simply whip out my credit card and pay online but since the transactions involved a lot of other people, I opted not to offer my card (hehe!).

After your annulment has been granted by the court, you need to file the court decree at the Civil Registrar’s office.  You need to do this in order for your marriage certificate (from your previous marriage) to be annotated with the details of the approved annulment.  This will serve as proof that you are now free to marry again.

Most of the time, filing the court decree at the City Hall is included in the petitioner’s lawyer’s services; however, in cases when the petitioner is left to process the documents on his own, he or she may find the following information useful.

Read on.

Step 1:

Register the Court Decree of Annulment at the City or Municipal Civil Registrar’s (C/MCR) Office where the court is functioning.  Secure a Certified True Copy of the Court Decree from the same office.

Step 2:

Secure a copy of the Certification of Registration of the court decree from the C/MCR Office.

Step 3:

Secure Certification of Finality from the court which rendered the decree.

Step 4:

Petitioners are usually advised to allow 60 days before requesting for a copy of the annotated Marriage Certificate.  After 60 days, they may secure a Certified True Copy of the Marriage Certificate from the C/MCR Office where the marriage is registered with remarks/annotations based on the Court Decree of Annulment.

Step 5:

If the PSA does not have it on file yet, the Marriage Certificate has to be endorsed (officially transmitted) to PSA by the C/MCR Office where the marriage was registered.  The petitioner may simply visit the C/MCR and advise that his marriage certificate has to be endorsed to the PSA.

While we anticipate the approval of the proposed 10-year validity of Philippine passports, we should continue to mark our calendars as to when we should be applying for a passport renewal.  Currently, Philippine passports have a 5-year validity period and most passengers who have less than a year before their passports expire are no longer permitted to leave the country.

This is a dilemma encountered by most OFWs.

So what happens if your passport expires while you are overseas?

Read on:

1.Allow a one year renewal period.

Avoid waiting until you only have a few weeks left before your passport expires.  The process of renewing your passport from abroad takes at least 8 to 12 weeks.

2. Visit the Philippine Embassy / Consulate General in the country where you are currently located.

a. Bring your passport and other pertinent documents related to your travel or stay.

b. The Philippine Embassy will send your renewal application to the Department of Foreign Affairs (DFA) office in Manila.

c. Check online if the Philippine Embassy in your area requires applicants to set up an appointment.  Most Philippine Embassies accommodate walk-in applications for passport renewal.

d. All details such as photographs, fingerprints, and signatures will be taken on-site.

3. What are the documents you need to bring?

a. Duly accomplished passport application form, typed or printed legibly on black or blue ink.

b. Latest passport.

c. One (1) photocopy of each of the data page/s of the passport.

d. Photocopy of any valid identification card where the middle name is fully spelled out, such as state4 ID, driver’s license, Birth Certificate, Marriage Certificate, or Baptismal Certificate.

e. Proof that applicant has not applied for foreign citizenship, e.g. resident alien card (green card).

These requirements may vary depending on the host country of the Philippine Embassy you will be applying to.

4. But how about if the passport IS already expired?

If your passport got lost or is already expired and you need to travel back to the Philippines, you have to secure a Travel Document from the Philippine Embassy in your host country.

What is a Travel Document?

  • Travel documents are issued to Philippine nationals returning to the Philippines, who for one reason or another, have lost their passport or cannot be issued a regular passport.
  • It is also issued to Filipino citizens who are being sent back to the Philippines.
  • It is valid for a non-extendable period of thirty (30) days from date of issuance and only for a one-way direct travel to the Philippines.  It cannot be used for re-entry to the host country.

The travel Document can only be issued when:

  • The consular officer determines that its use is warranted by emergency/critical circumstances.
  • It cannot be used as a short cut in complying with the requirements for the renewal of a passport or the replacement of a lost passport.

Renewing your Philippine passport abroad may be the last thing you would want to do while on a trip, whether as a tourist or an overseas worker.  You can avoid this by simply making sure that your passport is kept up-to-date.  Until the law on the 10-year validity period for Philippine Passports has been ratified, we all need to exert a little more effort in making sure that our passports are updated and are not expiring anytime soon.
