Alona is an illegitimate child, born to parents who were barely out of their teens.  Her mother gave her up for adoption when she was just a few days old, in exchange for a plane ticket from Manila to Iloilo.  She was never heard of from again.  Upon learning that his daughter was given to a complete stranger, Dexter (Alona’s father) requested for assistance from the barangay so he can take his daughter back.  After negotiating with the family who paid for Alona’s adoption, Dexter was finally able to take his daughter home and promised to do everything he can to raise her on his own.

Father and daughter sailed from Manila to Dumaguete and there, Alona grew up in her grandparents’ farm house while Dexter continued his studies in Cebu.

Alona is all grown up now and would like to apply for a passport so she can work abroad.  Her only problem is that she does not have a birth certificate and is clueless on how to get one.  Her father, Dexter, told her that she was born in Manila but since they have both migrated to Dumaguete, he is not sure if Alona’s birth can be registered in Dumaguete.

She has three problems:

  1. Alona does not have a birth certificate.
  2. She has not heard from her mother ever since she was born and in spite of several attempts to get in touch with her mother, all her efforts returned futile.
  3. She no longer lives in the city where she was born.

According to the Philippine Statistics Authority (PSA) website (www.psa.gov.ph) , cases such as this can be worked out by filing for an Out-of-town (because she no longer lives in the city where she was born), Delayed Reporting of Birth.

The requirements for delayed registration of birth are in this previous article we posted last month.  Once Alona has these documents on hand, she can present these to the civil registrar of the LCRO of Dumaguete who shall then forward the documents to the Manila City Hall for proper registration.

Since Alona is an illegitimate child and born on September 21, 1990, there is the issue on her last name and her parents’ acknowledgment of her birth.  Only her father is present, and essentially, willing to acknowledge her as his child.

According to the PSA, if the child’s birth certificate is not yet registered and the father acknowledges his paternity over the child, the child can use the father’s last name following the procedures for R.A. 9255.

Since Dexter wanted for Alona to use his last name on her birth certificate, they need to include these documents when filing for Alona’s registration of birth:

  1. Affidavit to Use Surname of Father (AUSF)
  2. Consent of the child, if 18 years old and over at the time of the filing of the document (this applies to Alona).
  3. Any two of the following documents showing clearly the paternity between the father and the child:
    • Employment records
    • SSS / GSIS records
    • Insurance
    • Certificate of membership in any organization
    • Statement of Assets and Liabilities
    • Income Tax Return (ITR)

    1. Kahit saang PSA office pwede kang kumuha ng birth certificate mo. Pero kung first corrected copy ang kukunin mo, dapat sa main office, sa East Avenue ka pumunta. Hindi naman aabutin ng maghapon. Pero agahan mo pa din.

  1. Kukuha po sana ako ng birthcertificate kc po magpapachange po ako ng surname ang gagamitin ko po eh yung sa papa ko since hndi pa po sila kasal nuon time na ipinanganak ako.. Ngayun po kasal sila at may marriage contract ..kaso po naka register po ako sa antipolo rizal.. But now im in ormoc city.. Ok lng po ba kahit dto ko nlng ipa change.. O need pa po tlaga na pumunta ko saan ka nakaregister ?

    1. Hindi mo pwedeng basta ipa “change” ang last name mo sa birth certificate mo.

      Kung kasal na ang parents mo, mag file kayo ng Legitimation Due to Subsequent Marriage para legal mong magamit ang last name ng father mo.

      Kailangan gawin niyo ito sa LCR kung saan ka naka rehistro.

  2. How about erroneous entry of gender? My daughter was a female since birth but it was erroneously put as male in her Birth Certificate. Her name is MA. ISOBEL LORENA SONGALIA MORALLOS. Date of birth is December 24, 1987, at EVRMC , Tacloban City. It was only discovered lately when she tried to apply for a job.

    What needs to be done about it?

    1. Hi Estrella,

      You can have the incorrect gender corrected at the city hall of your daughter’s birth place. Correction of gender is now only considered as clerical error so it should be an easier process to follow (no need for lawyers and court proceedings).

Good day po..magkaiba po kasi kami ng middle ng anak ko..pinaayos ko na po sa bicol sabi po sa quezon city ko daw po kunin..ano po po kaya yun aayusin pa lng o kukuhanin na…kasi sabi po ng lcr ng batangas po ay kung saan pinganak ang bata dun aayusin.tas po ang sabi sa quezon city daw po pupunta..

Good day.wala po akong nso birth kasi hindi pa ako na register ang tanong kulng pwd po bang madala ang apelyido ng papa ko e kinasal si mama ng ebang lalaki bali pangala ng asaw ang papa ko..ang problema pa ho wala ng papa ko patay pwd po bang madala ang apelyido ng papa ko kahit wala n siya..may trabaho na ako tapos ang apilyedo ng papa ko ana aking dinadala sa aking sss,philhealt,pag ibig at meron n din akong tapos ang apilyedo ko ang aking pi.apelyido sa akiing anak..tapos may na dinig akong balita hndi n daw pwd madala ang apilyedo ng papa ko yung ipinanganak ng 1988 to 2000 plz pakisagot po salamat.

      Maaaring mong magamit ang apelido ng tatay mo kung naka pirma siya sa likod ng birth certificate mo, bilang proof na kinikilala ka niya. Ngayon, since wala ka pang birth certificate at pumanaw na ang iyong ama, ibig sabihin, hindi na siya makakapirma sa birth certificate mo. Ang dadalhin mo nang apelido ay ang apelido ng nanay mo.

    1. Hi Akie,

      Ang ibig sabihin ng negative PSA birth certificate ay wala kopya ng birth certificate mo ang PSA.

      Kailangan mong mag verify sa LCR kung saan ka pinanganak kung meron silang kopya ng birth certificate mo.

      Kung meron: mag request ka na ma-endorse ito sa PSA para ma-certify ng PSA.

      Kung wala: Kailangan mong mag file ng late registration of birth.

  8. ask ko lang poh about sa nso ko …ang nakalagay sa nso ko ..apelyedo ng mama ko kasal naman mga magulang ko pero ang ginagamit ko apelyedo ng papa ko ,,nag apply ako ng ss d pwedi kase ,dapat ang dalhin ko apelyedo ng mama ko eh kasal naman cla ng papa ..paanu poh yan apeklyedo ng papa ko nagamit ko ngunit apelyedo ngmama ko ang nasa nso ko

  9. march 24 1994 po ako ipinanganak.
    ang problema ko po. wala po ako birth certificate or NSO. sabi ng mama ko. hindi daw ako napa rehistro. kaya wala akong birth certificate.. sinubukan kong mag tanung sa NSO about sa NSO ko ang kaso. no result daw ung name ko sa NSO. ehh applying po ako for abroad ang problema. hindi ako makakuha ng passport kc wala akong birth certificate..
    ask ko lang po kung papano mag pa late register at kung mag kano magagastos ko.. sana po matulungan nio ako. thankyou po.

  10. My problem is nanganak ko sa hospital tapos ang hospital walay live birth form. Ilang gikuha akong cp. Number kay twagan daw ko f naa nay livebirth form tapos one month later wla pang txt or tawag natanggap ko so pinuntahan ko ung hospital dn may anoh sa aming barangay na mananabang hihingi ako sa sa kanya isang live birth form tapos dinala ko sa hospital sabi sa taga doon late registrar na daw akong anak my mga requirements daw sa late regestrar. So nagalit ako sabi ko kasalanan ko ba nah late regestrar ung anak ko…. Marami nah silang sinasabi…. Tapos may problem is hanggang ngayon wla pa narehistro ung anak ko ang kulang ung NSO NEGATIVE result isa un sa requirements nla paano ba kumaha ng ganoon.? Ito lang salamat. Magtwo years old nah akong anak karong oct. 10 2016.

      1. Sir, related yong case ko sa thread na to,,nakuha ko ng ang mga NSO negative record at sa local civil registrar namin. Tapus naka execute na rin ako ng affidavit ng AUSF, meron na rin akong cert of death ng mother ng baby ko. Itong mga requirements na to pinasa ko na sa nagpaanak na midwife ng barangay namin. After 1 month, she told me needed ko daw ulitin ang requirements dahil nag expire na daw. TAMA ba siya? Mag eexpire ba ang NSO negative, ang negative din from local civil registrar at ang AUSF???? Pls i need clarification on this kasi di ko naman maulit kaagad ang mga yan at akoy isang ofw.

Problem ko po ung birth certificate ng anak ko…wala pong middle name ang birth certificate niya… di po kmi kasal ng ama niya.pero meron po signature ung ama niya sa birth certificate niya na nagpapatunay na xa ang ama…tapos poh ngayon high school na poh ung bata hinahapan po xa ng middle initial sa birth certificate niya…ano poh kailang gawin para mai ayos poh un…

  12. Pano po ba gagawin kung ang nakalagay sa marrge contrak ay iba kulang ang name nang parent or mali ano dpat gawin?
