Subject: RULES AND REGULATIONS GOVERNING THE IMPLEMENTATION OF REPUBLIC ACT NO. 10172 (An Act Further Authorizing the City or Municipal Civil Registrar or the Consul General to Correct Clerical or Typographical Errors in the Day and Month in the Date of Birth or Sex of a Person Appearing in the Civil Register Without Need of a Judicial Order, Amending for this Purpose Act Numbered Ninety Forty-Eight.)
Pursuant to Section 2 of Act No. 3753, the Office of the Civil Registrar General (OCRG) hereby promulgates the following rules and regulations of Republic Act No. 10172 which was approved on August 15, 2012 for the information, guidance and compliance of all concerned parties.
PRELIMINARY STATEMENT
Commonwealth Act No. 591 mandates the National Statistics Office (NSO) through the OCRG to carry out and administer the provisions of Act No. 3753 otherwise known as the “Civil Registry Law”.
This Order shall be suppletory to Administrative Order No. 1, Series of 2001 (Implementing Rules and Regulations, Republic Act No. 9048).
Republic Act No. 10172 amended Sections 1, 2, 5 and 8 of Republic Act No. 9048. Section 1 of this Amendatory Law provides, “No entry in a civil register shall be changed or corrected without a judicial order, except for clerical or typographical errors and change of first name or nickname, the day and month in the date of birth or sex of a person where it is patently clear that there was a clerical or typographical error or mistake in the entry, which can be corrected or changed by the concerned city or municipal civil registrar (C/MCR) or consul general in accordance with the provisions of this Act and its implementing rules and regulations.”
IMPLEMENTING RULES AND REGULATIONS
Rule 1. Authority to Correct Clerical or Typographical Error
The duly appointed C/MCR in accordance with the provisions of the existing laws, including the Consul General, are hereby authorized to correct clerical or typographical errors in the day and month (date of birth) or sex of a person in the civil register for birth.
Rule 2. Definition of Terms
As used in these rules, the following terms shall mean:
2.1. Clerical or typographical error – Refers to a mistake committed in the performance of clerical work in writing, copying, transcribing or typing an entry in the civil register on the entry of day and month in the date of birth or the sex of the person, which is visible to the eyes or obvious to the understanding, and can be corrected or changed only by reference to other existing record or records: Provided, however, that no correction must involve the change of nationality, age (refers to the correction on the year of birth), or legitimacy status of the petitioner/document owner.
2.2. Sex – Refers to the biological and physiological characteristics that define men and women.
2.3. Day and Month of Birth – Refers to the entry in the month and/or day of birth of the petitioner/document owner which is sought to be corrected.
2.4. Accredited Government Physician – Refers to a licensed doctor of medicine who is registered with the Professional Regulations Commission (PRC) and is employed in any government hospitals, health institutions, or public health offices.
2.5. Medical Certification – Refers to the certification issued by the accredited government physician attesting to the fact that the petitioner/document owner has not undergone sex change or sex transplant.

File ka ng correction of gender sa munisipyo kung saan ka naka register. Mga around 20k kasi may medical and publication pa yan eh.
My personnel’s surname and middle name was inter-change. Is this still under R.A. 10172 rules?
He already prepared the lists of requirements for R.A. 10172 and it is expensive to publicate for two consecutive weeks on a newspaper. He just want to be sure if he spend for the newpaper, that this will work, How much will be the estimated expenses for the attorney accceptance fees and final fees?

This is considered an error in encoding and can be corrected by filing a Petition for Correction under RA 9048.

Usually hindi pwede na OIC lang ang pipirma para sa processing. Kailangan yung legal, kasi yung pirma niya ang kailangan ng NSO office.

Wala pong full pledge na MCR sa aming munisipyo dahil nagretire na ang dating MCR. Marami po ang gustong magpa correct sa birth certificates
pwde po bang makipag MOA sa MCR sa katabing bayan para pumirma sa mga petition for correction?
Hindi ba naglagay ng OIC? Kasi hindi naman dapat matigil ang serbisyo dahil lang sa nag retire siya dapat napalitan siya agad.

Ano po dapat gawin pag yung middle name na nasa birth certificate ko ay middle name din ng father ko instead na sa mother? Magkano rin po magagastos?
File ka ng correction of entry sa munisipyo kung saan ka nka register.
Nasa magkano po kaya magagastos? Kelangan rin po ba non ng publication sa newspaper?
Hindi na kung correction lang naman ang gagwin. Mga 2k pag ganung process ang gastos.

Middle initial lang ang nakalagay sa iyo sa NSO mo? Dapat middle name yan. Yung sa mother mo correction of entry lang yun hinid na R.A 10172. Depende sa dami ng error ang amount plus filing fee.

I e evaluate nung LCR officer yung case mo kung saan dapat na proseso. Sila kasi ang mag advise sa iyo eh.

Yes puedeng ipa R.A 10172 yan. Ang official document mo ay yung NSO copy.

Yung na late na naregister sa dalawa i consider mo ng wala yun kasi hindi nila ire release sa iyo yun.

Wala ka na bang kamag anak na puede mong mapaki suyuan na mag file nito sa munisipyo kung saan ka pinanganak doon ito aayusin at idaan sa R.A 10172. Ipa inquire mo na din kung paano ang process at ano ang mga kailangang dokumento para maayos nila ang correction ng gender mo. Kung hihintayin mo kasi yan na ma implement sa Philippine consulate dyan sa milan matatagalan ka.,
good day…I have a close friend sa baptismal niya may ” Ma.” ang name nya same with her other document such as sss, prc, school records and bank accounts but in her birth cert wala po ” Ma.” pero meron siyang affidavit na stating that they are the same person.

Hindi naman kailangang ipa R.A 10172 yung case nya ang dapat nyang process is supplemental report since missing lang naman yung Ma. make sure kang na yun talaga ang spelling ha hindi buong Maria.

Ask ko lang po kung magkano fees ko.Sa case ko kasi, tama yung original birth date ng birthcert ko. pero nagkamali NSO sa pag encode ng birthday ko sa NSO copy. instead na 9-1-1982, naging 9-4-1982.

Puede na po yung price na yun kasi date lang naman ang namali kung year ang namali court order pa yan.

Punta sa local civil registrar, paayos ang maling date and place of marriage, dalhin ang NSO marriage cert ninyo bilang patunay. Pag naayos na ang record ng mga anak ninyo, pasok yan sa RA 10172, pa endorse ang naayos na record tungo sa NSO
galing na po ako don pero pilit nilang sinasabi na dadaan pa po sa korte…at pinagbabayad po nila kmi ng 40.000.00.para daw maayos.yong endorse sa NSO po ba matagal?

hello po sir, dalawa po ung name ng nanay ko. nagpalit po kasi sya ng name nun dalaga pa sya at akala nila ng tita nia ay okey lang yun.. 3 ouf 5 siblings ay tama edilberta ang name nya. sakin at sa 1 brother ko ay “gertrudes” sa bc ko pero sa marriage contract ko ay edilberta with affidavit kya tinanggap sa lcr. nung checked kopo sa nso, wala sya record, ano po ang ggawin ko para macorrect ang name nia.

Walang record ang nanay mo sa NSO? Negatove certificate ang nakuha mo dapat from NSO. Pupunta kayo sa local civil registrar kung saan siya pinanganak, check nyo kung may record siya doon.

Sa local civil registrar yan implemented. Inquire with Manila if they have the Implementing Rules and Regulations and if they are already using the new law.

You need to directly check with your LCR if implemented na nila.
Hello po, my problem in my NSO birth certificate is my first name and year of birth dahil d nag match sa birth certificate issued by LCR…with this RA 10172 i can correct my first name,how about my year of birth since what is included in the act is only the month and and day of birth? In all my scholastic record i used what is given by LCR in 1980s…pls help thanks
You can file for changes under RA10172 pero sa year you will need a lawyer to undergo court process though.
Or you can follow what is in your NSO BC record and change all your other records to follow it.

Dapat within this year alam na yan ng LCR mo. Mag follow up ka na lang every month kung alam na nila.

Hi, good day. My birthplace is in Romblon. My discrepancy sa Birth Cert ko regarding gender.Nag-inquire ako last week sa LCR dun pero sabi nila,my something(machine) daw na wait sila para maauthorize sila na magpalit sa birth cert ko ng gender. Di ko masyado maintindihan ang paliwanag nila why it would take time to do it kung approved na ang RA at for implementation na dapat.ganun ba talaga kabagal ang pag-implement ng law?
Well, as i learned, kailangan pala ng implementing rules and regulations which will beused pero LCR para ma implement yan.
That means they need to be trained to do it before the law can be executed

i was applying for my sss ID but they were requiring me to submit my NSO birth certificate if i
presented them my NSO which is error they might copy the wrong details can i show them my
petition so that they can validate the errors???or what else should i do????

Kung saan nakarehistro doon ka magaayos. Kung sobrang laki ng pinagkaiba ng pangalan na papabago mo, kailangan dumaan sa korte nyan, abogado at mga bayarin, mga 20,000 pataas ang gastos.

Kung may record ka na sa munisipyo, yun na ang official record mo, sayang lang ang late registration mo kasi hindi naman kikilalanin ang pangalawang registration.
Pabago mo na lang yung nasa record mo sa BC mo sa munisipyo
nabasa ko kanina about dito sa IRR tapos nagpunta agad ako sa LCRO…tapos nung tanungin ko sila…sagot lang nila wala parin daw yung IRR…taz sabi ko nabasa ko na sa internet…sagot nila sa internet lang daw yun’ sakanila wala pa daw…bat kya wla pa?

ako poy kasalukuyang naninirahan sa Milan Italy at may mali po sa aking birthcertificate na ang aking gender ay male..instead po na female.then last Monday po sept.16 2013 akoy nagpunta sa Philippine consulate in Milan pra po ayusin ang kamalian ng aking birthcertificate..but ang sabi po sa akin ay wala pa daw ini inform ang NSO regarding sa rep.act 10172…at sabi po sa akin ay tatawag daw sila sa akin kung may information na..kelan po kya ma iinform ang NSO ang Philippine consulate regarding rep.act 10172?at kailangan ko po sa madaling panahon ang aking birthcertificate na maayus..thank you ..godbless us all

actually ako poy nagpadala ng SPA pra sa kapatid ko at dinala po nya doon sa munisipyo namin at ang advice po nila sa kanya ay mayron naman na daw bagong law eto nga daw po yung rep.act 10172 na pwede ko namn na daw pong ayusin dto sa Milan…pero wala pa daw pong information galling ng NSO. ang consulate of milan.PWEDE po bang malaman kung kalian po ma implement?
Regarding sa ganyan ang advise ko is from time to time i check mo ito sa census.gov.ph para malaman kung napa implement na ito sa mga consulate offices.
