WHO MAY FILE THE PETITION?
Whether it is for correction of clerical or typographical error, or for change of first name, the petition may be filed by a person of legal age who must have a direct and personal interest in the correction of the error or in the change of first name in the civil register.
A person is considered of legal age when he is eighteen years old and above. Thus, a minor (less than eighteen years old) cannot by himself file a petition, either for correction of clerical or typographical error or for change of his first name.
Only the following persons are considered to have a direct and personal interest in the correction of clerical error or change of first name:
1. Owner of the record that contains the error to be corrected or first name to be changed
2. Owner’s spouse, children, parents, brothers, sisters, grandparents, guardian, or any other person duly authorized by law or by the owner of the document sought to be corrected.
WHAT SHOULD BE THE FORM AND CONTENT OF THE PETITION?
The petition, whether it is for correction of clerical error or for a change of first name, should be accomplished properly and in the prescribed form. Section 5 of RA 9048 and Rule 8 of Administrative Order No. 1, S. 2001 require that the petition should be in the form of an affidavit, hence, it should be subscribed and sworn to before a person authorized to administer oath.
Basically, the petition must contain the following facts or information:
• Merits of the petition
• Competency of the petitioner
• Erroneous entry to be corrected and proposed correction; first name to be changed and the proposed new first name
WHAT SUPPORTING DOCUMENTS ARE REQUIRED FOR CORRECTING A CLERICAL OR TYPOGRAPHICAL ERROR IN A CIVIL REGISTRY DOCUMENT?
The petition shall not be processed unless the petitioner supports it with the required documents. The supporting documents should be authentic and genuine, otherwise, the petition shall be denied or disapproved pursuant to Rule 5.8 of Administrative Order No. 1, S. 2001. The following supporting documents are admissible as basic requirements:
1. Certified machine copy of the certificate containing the alleged erroneous entry or entries
2. Not less than 2 public or private documents upon which the correction shall be based. Examples of these documents are the following: baptismal certificate, voter’s affidavit, employment record, GSIS/SSS record, medical record, school record, business record, driver’s license, insurance, land titles, certificate of land transfer, bank passbook, NBI/police clearance, civil registry records of ascendants, and others.
3. Notice and Certificate of Posting
4. Certified machine copy of the Official Receipt of the filing fee
5. Other documents as may be required by the City/Municipal Civil Registrar (C/MCR)

Sana po mabasa nyo ang tanong ko regarding sa problem ko po. Kung okay lang po ba na gamitin ko ang name at year of birth ko sa PSA kahit na may conflict sa year of birth sa kapatid kong sumunod sa akin. Salamat po hinihintay ko po talaga ang advice nyo.

Pero hindi ko po ba pwede sundin nalang ang nasa NSO ko? salamat po.
Hello po. Tanong ko lang po. Kasi po nalaman ko na ang name ko sa NSO ko ay Jeanelyn Layugan. Wala po akong middle name at ang Layugan po ay apelyido ng nanay ko. Pero mula po noon pa man Jeanelyn Layugan Mendoza na po ang gamit ko. Gamit ko po ang apelyido ng tatay ko sa school hanggang sa mga government Id’s ko po. Pinaayos ko na po yun sa kapatid ko na maging Mendoza ako kasi kasal naman ang nanay at tatay ko at may nakalagay sa Birth Certificate ko na galing sa munisipyo na acknowledged na ako ng tatay ko. Sabay po pinaayos ng kapatid ko ang PSA nya at PSA ko. Yung kanya po ang unang naayos ngayon po ay Mendoza na sya pero yung akin po ay questionable dahil physically imposible daw po dahil sa birthday namin. Ang birthday ko po ay Nov. 1992 at ang birthday nya ay Feb. 1993. Physically imposible daw po. Ngayon po ang pagkakaalam ko po kasi pag year ng kapanganakan ang mali ay kailangan po sa korte ang process. Wala po akong pera para doon. Kaya ang iniisip ko po ay kung pwede ko po ba sundin nalang ang nasa PSA ko na Jeanelyn Layugan? Hindi po ba yun magkocause ng problem sa future at paano po ang mga government ID’s ko kung ganun. Salamt po.
1991 po talaga ang year of birth ko. Pero dahil sa proseso nun sa tagal at cost. Gusto ko nalang po sundin ang PSA ko. Kaya lang po ang concern ko ay kung okay lang po ba yun kahit na ang lumalabas samin ng kapatid ko ay physically imposible dahil sa 3 months na pagitan ng kapanganakan nya sa kapanganakan ko.

Ang reason kung bakit hindi na-grant yung pag gamit mo ng surname ng father mo ay dahil sa error sa year of birth mo. Conflict ito sa year of birth ng kapatid mo.
Kailangan ma-correct muna ang year of birth mo through court order, bago mo ma-apply ang last name ng father mo sa birth certificate mo.
Court order lang ang tanging paraan para ma-correct ang year of birth.
Iwasan mo ang fixers na magsasabi sayo na magpa late register ka na lang — dahil yan ang madalas na solusyon na ina-advise nila.
Pwede kang humingi ng assistance sa Public Attorney’s Office (PAO) para hindi ka na muna gumastos sa attorney’s fees.

1. Kinasal ba ang mga magulang mo matapos kang ipanganak? Kung oo, legitimation due to subsequent marriage ang dapat mong i-file.
2. Kung hindi kinasal ang mga magulang at walang acknowledgment ang tatay sa birth certificate, AUSF (Authority to Use Surname of Father) ang dapat na i-file. Pero dapat may pirma ang tatay sa document.

Ibig sabihin hindi nakita ng DFA yung pagkakaiba ng birthday mo sa NSO birth certificate mo? Eventually you will have two choices, change your NSO birth cert via court order. Prepare 20K up kasi may lawyer required.
Or change all your records to follow your birth certificate information.

nung kumuha ako nursing board exam at ng passport sa dfa di po ako nagkaproblema.. both requires birth certificate from nso, di ako nagkaproblema nun. pero ngaun po n mag papa red ribbon sana ako sa dfa ng BC pra sa requirements ng visa, nkita ko po kc n may mli sa bc ko, ang nkalagay n birth date is june 21 1981, but may real bday is june 11 1986.. pnu ang gagawin ko pra maayus ito… pati po pla registration number ay iba kumpra sa BC n galing sa munisipyo.. plz guide me what i am going to do.. thanks po.

May, go to the local civil registrar to have it corrected. Bring the NSO birth certificate
